Vodafone Express Wi-Fi
The Express Wi-Fi (Service) starts on 19 January 2019 at 00:00:01 GMT. The Express Wi-Fi is a product of Ghana Telecommunications company Limited (Operating under the brand name Vodafone Ghana and hereinafter referred to as Vodafone or the Provider)
1.Acceptance of Terms of Use
The following provisions define the terms and conditions ('Terms and Conditions') governing the Service. By accessing and using the mechanics and rewards provided in this Service, the Subscriber shall be deemed to have consented and agreed to these Terms and Conditions and be bound accordingly.
All Subscribers warrant that they have read carefully and have understood fully these Terms and Conditions which are also posted on http://www.vodafone.com.gh.
Anyone with a Wi-Fi capable device and the ability to receive a one-time SMS will be able to use Express Wi-Fi without switching SIM cards by connecting to the available hotspot. Customers can access Express Wi-Fi on most Android and iOS phones, tablets, and laptops. Customers can also purchase Express Wi-Fi data packs from a retailer in your community
1. Definitions
1.1 "the Service" shall mean the provision of the Wi-Fi facility by Vodafone to allow the Subscriber to access to the Internet.
1.2 "The Subscriber" shall mean a prepaid customer, regardless of the network registered on, who purchases a data pack to use the Service.
1.3 "Access" means connection access to the world-wide computer network known as the Internet through Vodafone
1.4 "Fee" means that amount in respect of providing Access as specified in the Particulars
1.5 "Spam" means unsolicited and/or unwelcome advertising material or information, usually sent via e-mail or newsgroup.
1.6 "Credit Period" shall mean the time period for which access to the Service has been paid by the Subscriber
1.7 'Particulars'; means the data package specified on the Express Wi-Fi data packs.
2. Features of the Service
The Service is a fast and affordable public Wi-Fi hotspot service available in certain communities in Accra.
2.1 A Subscriber, regardless of the network registered on can connect to use the Service through the Express Wi-Fi App or through the web based application. The Subscriber who intends to use the Service and enjoy its full benefits must follow the steps set out below:
2.1.1 Log unto the Express Wi-Fi App or the web based portal and input their phone number on the landing page.
2.1.2 An SMS with a 4 digit PIN will be sent to the number registered on the landing page. This PIN must be entered on the landing page to confirm the completion of the registration process.
2.1.3 The Subscriber must have a Wi-Fi enabled device and must get into an Express Wi-Fi hotspot territory. The Subscriber shall be entitled to a one-time free data pack as determined by Vodafone which can only be used in an Express Wi-Fi hotspot range.
2.1.4 For all subsequent log ins at the Express Wi-Fi location, the Subscriber must purchase a data pack from any identifiable Express Wi-Fi Retailer. The Retailer shall request for the phone number of the Subscriber and provision the data package purchased to the phone number given.
2.1.5 The Subscriber shall receive an SMS confirming the success of the transaction and the data package will show on the landing page of the Express Wi-Fi portal.
2.1.6 The Data packages at the initial stages shall have the following values and validity periods: 100MB valid for 1 day 300MB valid for 3 days 1 GB valid for 7 days
2.1.7 The data package purchased can be used at any Express Wi-Fi hotspot location. The data package shall rollover only if the customer purchases an equal or higher package (than the previous one) within 24 hours after the expiry of the previous package.
2.1.8 The Express Wi-Fi data Packages can be used concurrently with all other stand-alone bundles for Vodafone customers.
2.1.9 The data package shall take precedence over any data bundle subscribed to by a Vodafone customer.
3. Illegal use of Service.
3.1 The Subscriber shall not use the Service for any illegal activity. This includes but is not limited to illegal transactions or illegal entry to unauthorized sites anywhere on the Internet. Illegal transactions include the use of the Service in credit card fraud, all forms of trafficking (e.g. child and drug trafficking) on the internet, especially with Vodafone's domain @vodafone.com.gh. The Subscriber is cognizant of the fact that the consequences of illegal usage could result in Vodafone's domain being blacklisted
3.2 The Subscriber shall not use the Service to transmit unsolicited spam and shall not forge email headers
3.3 The Subscriber shall indemnify Vodafone against any actions brought against it in respect of the Subscriber's acts, omissions, including, but not limited to, defamation or breach of copyright arising from such acts or omissions and against all costs, charges, claims, demands, damages and expense which Vodafone may incur in any such action.
4. Confidentiality.
4.1 The Subscriber shall maintain the confidentiality of passwords and other access codes to the Service, and take reasonable precautions to avoid the disclosure of these and other confidential information relating to the Service.
4.2 The Subscriber shall not in any way resell or redistribute the Service to any other person unless it is so disclosed at the time of the application and the Subscriber obtains the written consent of the Provider.
4.3 The Subscriber is solely responsible for the activities of any persons whom the Subscriber allows, by any act or omission whether negligent or otherwise, to access the Subscriber's account
4.4 The Subscriber undertakes and agrees that the Provider does not and cannot monitor or control the content and information accessed via the Internet and that the Provider shall not be held responsible in any way for content or information accessed via the Internet.
5. Disclaimer.
5.1 Vodafone disclaims any and all liability for the contents of material that the Subscriber may find inappropriate, offensive, inflammatory or adult in nature.
5.2 Wi-Fi service can only be accessed only at a Vodafone Express Wi-Fi a hotspot location. Vodafone will not be held responsible in the event that the service is not accessible at other places.
6. Instability of Service.
6.1 The Service may be unavailable at times either due to scheduled maintenance upgrades, operational reliability or due to factors beyond Vodafone's control.
6.2 Vodafone makes no guarantee as to the availability of the Service at any time and shall not be liable for any claims against it from the Subscriber due to the lack of availability of the Service. Nor shall it be held responsible for any loss or inconvenience suffered by the Subscriber due to lack of availability of the Service.
6.3 Vodafone will use its best endeavours to provide at least twenty-four (24) hours' notice of any disruption to the Service. The Subscriber acknowledges that it may not be possible for Vodafone to give any notice at all under some circumstances.
6.4 Vodafone offers Call Centre support 24 hours daily. However, Vodafone can only provide technical support between the hours of 8:00am and 5:00pm daily.
7. Charges and Payment.
7.1 All new Subscribers to the Service will be required to purchase a data pack(s) to be able to access the Service
7.2 The Subscriber shall make payments by cash, or any other payment method deemed acceptable by Vodafone.
7.3 Vodafone reserves the right to vary the Charges and conditions associated with the Service from time to time. Vodafone shall give the Subscriber notice of any such variation.
8. Suspension and Termination.
8.1 If the Subscriber chooses not to make use of the Service for the duration of the Credit Period, the Subscriber shall not be entitled to any credit or refund for any unused period.
8.2 Vodafone reserves the right to terminate the Access without notice if, in the opinion of Vodafone the Subscriber misuses or abuses the Service or has breached its obligation herein.
8.3 Misuse or abuse of the Service shall be determined by the Provider and there shall be no refunds or reimbursements of charges and fees should the Service be terminated under such situations.
8.4 Vodafone may immediately without notice, suspend the Service to the Subscriber wholly or partially for any reason , including without limitation, where the Subscriber engages in any activity (or permits any activity) which Vodafone ( as it, in its sole discretion shall determine ) considers (a) to be contrary to existing legislation or regulations applicable to provision of the Service or (b) is or likely to have an adverse impact on the quality of the Service or the integrity of the Vodafone Network. Such activities may include (but are not limited to) using the Service to make calls to or from any Mobile Gateway, "SIM box" or similar or related devices. Vodafone reserves the right to fully defend its position and take such further action as it considers necessary for this purpose.
9. Limitation of liability
9.1 Provider accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.
9.2 Provider shall make commercially reasonable efforts to ensure that the benefits promoted as being available to members will actually be available as represented. However, Provider does not guarantee or warrant that such benefits shall always be available. Provider advises members to check availability of the desired benefits prior to redemption of the said benefits.
9.3 If for any reason any aspect of this Service is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of Provider which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Service, Provider may in its sole discretion modify or suspend the Service. If an act, omission, event or circumstance occurs which is beyond the reasonable control of Provider and which prevents Provider from complying with these Terms and Conditions Provider will not be liable for any failure to perform or delay in performing its obligation.
9.4 Provider reserves the right to suspend the Service temporarily or permanently for legal, regulatory and for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Provider undertakes where possible to restore the Service as soon as practicable after any temporary suspension period.;Provider shall not be liable for any claims, losses or injuries whatsoever the Subscriber may suffer as a result any such suspension

10. Disclaimer of Warranties
10.1 Provider makes no warranty, implied or express, that any part of the Service will be uninterrupted and error-free.
10.2 Neither Provider nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any Subscriber for participating in the Service.
11. Miscellaneous
11.1 A Subscriber's continued participation in Service constitutes the member's acceptance of any changes to these Terms and Conditions. Participants are responsible for remaining knowledgeable as to any changes that Provider may make to these Terms and Conditions. Provider will endeavour to make available the Terms and Conditions and any changes thereto on Vodafone website www.vodafone.com.gh
11.2 If Provider or any Partner improperly denies a participant any benefits that the participant ought to have earned under the Service, the Subscriber's exclusive remedy shall be the issuance of the improperly denied benefits by Provider, if available, or such other reasonable, alternative and comparable benefits as determined by Provider. In the event of any of the aforementioned improper denials, the liability of Provider shall be limited to the value of the benefits concerned.
11.3 Personal data relating to Subscribers in this Service that may be processed and used for purposes of the Service shall be in accordance with applicable Data Protection Law.
11.4 Provider reserves the right to terminate, suspend, cancel or amend the offer and these Terms and Conditions, reward structure, participation of any Provider Subscriber in the Service at any time. Any changes will be posted on Vodafone website and other online platforms and shall be binding on a Subscriber. Provider will use all endeavours to minimise any effect on the consumer in order to avoid disappointment.
11.5 In the event of dispute regarding the interpretation of the Terms and Conditions, conduct and all other matters relating to the Service the decision of Provider shall be final and without appeal.
11.6 These Terms and Conditions will remain in full force and effect while the Service lasts (not taking into account temporary suspensions of the Service for operational reasons, e.g. for repairs, planned maintenance or upgrades).
11.7 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.
